The Phenomenon of the Historical and Cultural Preserve in Russia: Legal Uniqueness and the Mission of Preserving Living Culture

The article presents a comprehensive study of the historical and cultural preserve (HCP) as a unique heritage conservation institution in the Russian Federation. Based on an analysis of Federal Law No. 73-FZ, it reveals the fundamental difference between the legal status of an HCP, defined as a special territorial regime, and the status of a museum-preserve, which is a cultural institution. The empirical basis of the research is the case study of the Mezhelik Historical and Cultural Preserve, Republic of Altai, the only HCP of its kind in Russia. The relevance of the work is determined by the need to preserve integral historical, cultural, and natural territories in the context of sustainable tourism development. The author argues that the legal model of an HCP possesses special potential for the protection of cultural landscapes and authentic intangible heritage in its living tradition, unlike museum-preserves, which are primarily focused on tangible objects. The research employs methods of systems analysis, comparative law, and case study. The results demonstrate the promise of the HCP model for the rational use of heritage and the sustainable development of tourism. It is concluded that a more active implementation of this organizational and legal form is advisable for the preservation of Russia's sacred territories.
